• Signed into law on December 15, 2025, Bill 9 is legislation that phases out short-term rentals operating in apartment-zoned districts across Maui.
• The ordinance removes transient vacation rentals as a permitted use in A-1 and A-2 apartment districts to increase the availability of long-term housing for residents.
• Properties with Hotel or Resort zoning are completely unaffected by this law.
• This refers to a list of condominium properties on Maui that were historically grandfathered in to legally operate as short-term rentals, despite being in apartment-zoned areas rather than hotel-zoned areas.
• The list was named after former Maui County Deputy Corporation Counsel Richard Minatoya, who issued a legal opinion in 2001 allowing these specific pre-1989/1991 properties to continue operating as STRs.
• Bill 9 specifically targets this list, removing the Minatoya exemption and returning these units to long-term residential use.
• In late 2025, the Maui County Council formed a Temporary Investigative Group (TIG) to study the economic impacts of Bill 9.
• The TIG released a document known as "Exhibit 2," which identifies specific apartment-zoned condo complexes (roughly 4,500 units) that they recommend be saved from the Bill 9 phase-out.
• The TIG recommended these specific properties be officially rezoned into newly created Hotel Districts (H-3 and H-4) to permanently protect their short-term rental rights. Until the County Council officially passes this companion rezoning legislation, properties on this list carry a "Yellow Status" (relative safety, but pending final votes).
• The amortization period is the legally defined grace period during which current apartment-zoned short-term rentals can continue to operate before they must shut down entirely.
• West Maui: The amortization period ends on December 31, 2028, meaning short-term rental operations must cease by January 1, 2029.
• All Other Areas (Including South Maui): The amortization period ends on December 31, 2030, meaning short-term rental operations must cease by January 1, 2031. There are no opt-outs or renewals available beyond these dates.
In Maui County, a Transient Vacation Rental (TVR) or Short-Term Rental (STR) is legally defined as the rental of a housing unit to transients for any period of less than 180 consecutive days
• Hotel/Resort Zoning (H-1, H-2, H-M): These districts are explicitly intended for short-term vacation rentals and are fully protected under current county law. These are "Green Status" properties.
• Apartment Zoning (A-1, A-2): These districts are intended by the county for long-term residential housing. Under Bill 9, short-term rentals are no longer permitted in these zones after the amortization periods expire.
